Do I have a lawsuit if the airbags did not deploy in my auto accident?

I was driving my SUV and hit a tree head on driver’s front end and side door took full impact. Airbags did not deploy. Broke my left leg in four places and broke right hand in two several other lacerations and pulmonary contusions.

Depending on the specifics of an accident, you may have a cause of action for product liability. You should consult a personal injury or product liability attorney about filing suit against the vehicle's manufacturer for the failure of the safety equipment.

You may have a claim for faulty airbags but you must keep the following in mind. In order to prevail, you must hire an expert who will testify that the airbags are faulty (more than likely, the car manufacturer will have an expert of its own stating the opposite). This can be very expensive. In addition, you must be able to prove what injury occurred AS A RESULT of the faulty airbag. This may be a difficult thing to prove as you could have received your injuries regardless of the airbag deployment. Hitting a tree oftentimes causes great injury.
