Can I get compensated, for my vehicle that was damaged by an auto accident?

I was turning right onto far right side of a double-lane and a guy cut me off, and sideswiped my car. I would like a compensation to get it fixed. Can I get compensated, for my vehicle that was damaged by an auto accident?

In Massachusetts, you can be compensated by another party's insurance if you are less than 50% at fault. We have a comparative negligence statute which looks at relative fault for both vehicles involved. If the other party is 100% at fault for the accident, then the damage to your vehicle is paid 100%. However, if you are determined to be, let's say 10% at fault, then the other party will only pay 90% of your repairs and you will be responsible for your portion. You should contact your own insurance company and see if their investigation is complete in regard to assessing fault.
